During the armed conflict that took place on the territory of the former Yugoslavia, Bosnian Serb forces including the Army of the Republika Srpska (RS), the police and paramilitary forces perpetrated attacks against the civilian population in the Rogatica municipality by detaining, murdering, raping and abusing persons of Muslim and Croat ethnicity. The Accused, Radisav Ljubinac, was a member of the RS living in Rogatica in 1995.

By a judgment of 25 April 2007, Section I of the War Crimes Chamber in the Court of Bosnia and Herzegovina convicted the Accused of crimes against humanity and sentenced him to 10 years’ imprisonment for his role in the forcible transfer of civilians and their maltreatment at the Rasadnik camp in Rogatica. By the present verdict, the Appellate Panel of the War Crimes Chamber confirmed the verdict of Section I and dismissed the appeals of the Prosecutor’s Office and the Defence. It amended the verdict only so far as to reflect Section I’s failure to dismiss a charge, which the Prosecutor had dropped during the trial. 

In the second instance verdict of the Gojko Janković case, the Appellate Panel upheld the defence appeal only in the part of the legal qualification of the acts constituting crimes against humanity. It refused all of the other points of appeal entered by the defence, including the modification of the long term imprisonment of 34 years.

The case of Gojko Janković was the second case referred by the ICTY to the Court of BiH for further processing.

Ilija Jurišić was a member of the Bosnia and Herzegovina police reserve forces as well as a high-ranking commander in the Tuzla-based State Security Operational Centre. Later, Jurišić exercised control over all armed troops deployed over the territory of Tuzla. In the latter function, Jurišić allegedly ordered his subordinates to attack a column of soldiers of the Yugoslav Peoples' Army (JNA) on 5 May 1992, while this convoy had just started to withdraw from Tuzla. As a result of this attack, at least 92 JNA soldiers were killed and more than 30 others were injured.

Abimael Guzmán was the founder of Shining Path, a guerrilla group in Perú. The aim of Shining Path was to overthrow the Peruvian government. Between 1980 and 2000, Shining Path was responsible for an extensive campaign of violence, including the killings of thousands of people.

Guzmán was arrested in 1992, and in the same year, a secret military court sentenced him to life imprisonment. This decision was found to have been based on unconstitutional laws in 2003, and resulted in the retrial of Guzmán and the other leaders of Shining Path. The charges included terrorism, murder and other offences. The lower Peruvian court found Guzmán guilty of terrorism and other offences, sentencing him, and his second in command, Elena Iparraguirre, to life imprisonment. The other ten co-defendants were also found guilty, and received sentences between 24 and 35 years of imprisonment. 

The Supreme Court of Justice upheld the life sentence against Abimael Guzmán and Elena Iparraguirre. The Supreme Court also increased the sentences of some of the co-defendants up to 35 years of imprisonment, and confirmed the sentences of others.

Both accused, Enes Handžić and Senad Dautović, were found guilty of war crimes against humanity for their participation in the unlawful transport of civilians to camps, forced labour, inhumane treatments and murders, together with the civilian authorities of the Bugojno Municipality and the military units of the Army of BiH.

The case of Senad Dautović is currently on appeal.
