Ms. Shannon Conley has pleaded guilty before US courts to having tried to travel to Syria in order to join and provide support to Al Qaeda / ISIS. Ms. Conley met her fiancé, a jihadi fighter associated with these groups, online and they shared a belief in violent jihad. She subsequently planned to join him and the terrorist group, and arranged to receive some training in weapons and military tactics. However, Ms. Conley was arrested prior to her departure on a flight to Turkey in April 2014 and was sentenced in 2015 to 4 years’ imprisonment.   

Two men, Mr. Nader Elhuzayel and Mr. Muhanad Badawi, were found guilty by a jury of conspiring to support the Islamic State on 21 June 2016 after earlier pleading not guilty. In particular, Mr. Elhuzayel, who was arrested prior to boarding a flight to Israel via Turkey at Los Angeles International Airport, was found to have encouraged others to support and join the Islamic State, and to have vowed to travel to Syria to fight for the terrorist group himself. Both were also convicted of financial fraud charges, the proceeds of which were used to fund the travel. A decision with regard to sentencing is anticipated later this year. 

In its self-declared “War on Terrorism,” the United States began the “High Value Detainee” program, where suspected terrorists would be subjected to special interrogation and detention. The program was managed by the CIA, which detained suspects in secret detention facilities (“black sites”) in cooperation with other foreign governments.

Lithuania cooperated with the program by allowing the transfer of suspected terrorists through its territory. An alleged member of al-Qaeda, Mr. Zayn Al-Abidin Muhammad Husayn (known as Abu Zubaydah) was held in a black site known as “Detention Site Violet” where he was subjected to solitary confinement, hooding, and other forms of ill-treatment.  

The European Court of Human Rights found that Lithuanian authorities clearly knew the purpose of the black site and the likelihood of Abu Zubaydah’s being tortured. The Court concluded that by enabling the transfer of Abu Zubaydah to and from the site, Lithuania was equally responsible for his ill-treatment.

Al Bihani, Yemeni citizen and Saudi Arabian national, travelled to Afghanistan in May 2001 on jihad (holy war). He became a member of the 55^th Arab Brigade and, by his own admission, acted as a cook. The Brigade carried out a number of operations in support of the Taliban against the United States and its allies in the Northern Alliance. Al Bihani was transferred to the custody of the United States Armed Forces and thereafter to Guantanamo Bay following the surrender of his unit. Alleging the illegality of his detention at Guantanamo, al Bihani petitioned the District Court for the District of Columbia for a writ of habeas corpus. His petition was denied on the grounds that he was an “enemy combatant” within the meaning of the definition of such decided by the Court in its earlier case of Boumedienne v. Bush. On appeal, the Court of Appeals for the District of Columbia dismissed Al Bihani’s appeal.
