Habré: Hissène Habré v. Republic of Senegal

Hissène Habré was the President of the Republic of Chad from 1982 until 1990. During that time, he established a brutal dictatorship which, through its political police, the Bureau of Documentation and Security (Direction de la Documentation et de la Sécurité (DDS)), caused the deaths of tens of thousands of individuals. Residing in exile in Senegal, he was unsuccessfully brought before the Senegalese courts in 2000-2001 at which time the Supreme Court of Senegal confirmed that it did not have jurisdiction to hear the case as the acts allegedly committed by Habré were not criminalised under domestic law. In response to an African Union mandate to prosecute Habré, Senegal amended its legislation to provide for universal jurisdiction over crimes against humanity and acts of torture committed by foreign nationals outside of Senegalese territory.
Habré brought a complaint against Senegal before the Court of Justice of the Economic Community of States of West Africa alleging that the new legislation breached his human rights, including the principle of non-retroactivity of the criminal law. The Court held, in a decision that has been criticised for lack of legal basis, that Senegal would violate the principle of non-retroactivity if its tried Habré in its domestic courts. Instead, international custom mandates that Senegal establish a special tribunal to try and prosecute Habté.
Case concerning the Arrest Warrant of 11 April 2002 (Democratic Republic of the Congo v. Belgium)

On 11 April 2000, a Belgian investigating judge of the Brussels Tribunal of First Instance issued an arrest warrant in absentia against the incumbent Minister for Foreign Affairs of the Democratic Republic of Congo (DRC), Abdulaye Yerodia Ndombasi, charging him with offences constituting grave breaches of the Geneva Conventions I–IV (1949); Geneva Conventions Additional Protocol I (1977); Geneva Conventions Additional Protocol II (1977), and crimes against humanity. In the warrant, Mr Yerodia was accused of inciting racial hatred in various speeches in the DRC in August 1998, which had contributed to the massacre of several hundred persons and, thus, he was charged as perpetrator or co-perpetrator of these crimes. The arrest warrant, which asked States to arrest, detain, and extradite Mr Yerodia to Belgium, was transmitted to the DRC in June 2000 and simultaneously circulated internationally through Interpol. On 14 February 2002, the International Court of Justice ruled that the issuance and circulation of the arrest warrant violated Belgium’s international obligations towards the DRC in that Belgium failed to respect, and infringed, Mr Yerodia’s immunity as Minister for Foreign Affairs and the inviolability enjoyed by him under international law. The Court required Belgium to cancel the arrest warrant and inform as such the authorities to whom it was circulated.
El-Shifa v. USA: El-Shifa Pharmaceutical Industries Company and Salah El Din Ahmed Mohammed Idris v. United States of America

In August 1998, the US embassies in Kenya and Tanzania were bombed by terrorists loyal to Osama bin Laden. In retaliation, President Clinton ordered a missile strike on the El-Shifa pharmaceutical plant in Khartoum, Sudan, arguing that it was a base for terrorism. Later, it was proven that the plant had no ties to terrorists. Therefore, El-Shifa Pharmaceutical Industries brought complaints against the United States in the US Court of Federal Claims.
In November 2005, the District Court found that El-Shifa Pharmaceutical Industries raised a non-justiciable political question (which foresees that courts have no authority to hear or adjudge on matters that raise political, rather than legal, questions) in asking the Court to adjudge on the President’s powers to designate as enemy property the private property of the chemical plant in Sudan.
In March 2009, the Court of Appeals affirmed the decision of the District Court, holding that the case raised a political question, and therefore barring the court from hearing the matter. El-Shifa Pharmaceutical Industries attempted to exclude from its appeal the political question doctrine, however, the Court of Appeals found that the other raised claims were ‘inextricably intertwined’ with the political question doctrine and therefore, must be considered together. The Court of Appeal affirmed the District Court’s earlier finding that the raised issues are political questions and hence, non-justiciable.

In March 2003, the US Court of Federal Claims dismissed the complaints as non-justiciable based on the ‘political question doctrine’ (which foresees that courts have no authority to hear or adjudge on matters that raise political, rather than legal, questions). Accordingly, the Court found that it did not have jurisdiction, even if the complaints raised issues under the Fifth Amendment to the US Constitution. Therefore, El-Shifa’s complaints were dismissed.

Following the decision of the Indonesian government taken in early 1999 to offer East Timor the opportunity to vote for independence or for autonomy within the Republic of Indonesia, violence erupted in East Timor. The defendants in this case took part in a widespread or systematic attack directed against civilians that were in favour of an independent East Timor. One of the accused, Herman Sedyono, was the Bupati (District Administrator) of the Covalima District, one of the 13 districts in East Timor. As such, he was bearing the primary responsibility for maintaining peace and security in the region. Most of the other accused were Commander or just member of the Indonesian security authorities (TNI) or the Indonesian police force (POLRI), which were both promoting autonomy within the Republic of Indonesia.
In 1999, the Mahidi and the Laksaur pro-Indonesian militia groups, with the help of the TNI and POLRI, and with support from the Covalima District administration, repeatedly committed attacks against the Covalima population (mainly against those that were in favour of independence). The attacks involved crimes such as unlawful arrests, destruction of property, detention, and murder. The 16 accused were charged with encouraging, assisting and failing to stop, arrest or prosecute the perpetrators of the crimes.
