On 11 September 1973, General Augusto Pinochet Ugarte assumed power in Chile as a result of a military coup that overthrew the then government of President Allende. Pinochet was the Commander in Chief of the Chilean Army until 1974 when he assumed the title of President of the Republic. His presidency lasted until 1990 and his role as Commander in Chief until 1998. His regime was known for its systematic and widespread violations of human rights, with allegations of murder, torture and hostage taking of political opponents.

In 1998, during a visit to the United Kingdom for medical treatment, Pinochet was arrested by the English authorities with a view to extraditing him to Spain where a Spanish judge had issued an international arrest warrant. His extradition was, however, not to proceed smoothly as Pinochet applied to have the arrest warrant quashed on the grounds that as a former Head of State he enjoyed immunity from criminal proceedings.

The present decision of 24 March 1999 by the House of Lords held that Pinochet is not entitled to immunity in respect of charges of torture and conspiracy to commit torture where such conduct was committed after 8 December 1988, the date upon which the 1984 Torture Convention entered into force in the UK. This temporal qualification significantly limited the charges for which Pinochet can be extradited to Spain as the majority of the conduct alleged was either not an extraditable offence or was committed prior to this date. Under English law, it was now for the Home Secretary, then Jack Straw, to decide whether or not to issue an authority to proceed with extradition.

Who can be held responsible in a Court of law for human rights violations? In this case, victims and relatives of victims of the South African apartheid regime sued several corporations for their involvement in South Africa in the period between 1948 and 1994. They were liable, the plaintiffs reasoned, because the police shot demonstrators “from cars driven by Daimler-Benz engines”, “the regime tracked the whereabouts of African individuals on IBM computers”, “the military kept its machines in working order with oil supplied by Shell”, and so forth. The main legal issue to be solved by the District Court was whether it had jurisdiction over this case under the Alien Tort Claims Act (ATCA), which allows non-Americans to sue in federal Court for a violation of a small group of international norms. The District Court ruled that this case did not fall within the scope of the ATCA for several reasons. They could not be qualified as state agents carrying out illegal state actions, business activities in South Africa during the apartheid era could not be defined as a breach of the ‘law of nations’ under the ATCA and neither could aiding and abetting to an international norm violation.

Julio Simón was a member of the Argentinean Federal Police during the military dictatorship of 1976-1983 and had been charged with kidnapping, torture, and forced disappearance of persons. Julio Simón argued as his defence that he benefited of immunity from prosecution under the Amnesty Laws of 1986-1987.

In 2001 a lower court had declared the Amnesty Laws unconstitutional. After successive appeals the issue came before the Supreme Court.

The Supreme Court ruled that the Amnesty Laws were unconstitutional and void for several reasons. First, since the adoption of the Amnesty Laws, international human rights law developed principles that prohibited states from making laws aimed at avoiding the investigation of crimes against humanity and the prosecution of the responsible people. By incorporating the ACHR and the International Covenant on Civil and Political Rights into the Constitution, Argentina assumed the duty to prosecute crimes against humanity under international law. Because the Amnesty Laws were designed to leave serious human rights violations unpunished, they violated these treaties and the Constitution of Argentina. Moreover, in the Barrios Altos v. Peru case the Inter-American Court of Human Rights held that states should not establish any measures that would prevent the  investigation and prosecution of serious human rights violations.

As part of the operation to erect a wall in the West Bank, Israel constructed a wall around the Alfei Menashe settlement between 2002 and 2003. This wall also circumscribed five Palestinian villages, the residents of which filed a petition to have the wall removed.

The Supreme Court stated that the military commander of the West Bank had the authority to decide on the erection of a fence, but only if this is necessary for security or military considerations. Also, these security or military considerations had to be proportionate to the infringement on the rights of the Palestinians. In this case, the effects of the wall on everyday life of the residents of the Palestinian villages were so severe that alternatives should have been considered. This had not been the case, the Court stated. Therefore, it ordered the respondents to consider alternatives.
